§ 4-1. Approval of subdivision plats required.

  • From and after the date of filing a certified copy of these regulations with the Probate Judge, no subdivision plat of land within the planning jurisdiction, as defined in Article II of these regulations, shall be filed or recorded nor shall any lots be sold until the plat shall have been submitted to and approved by the Planning Commission. The Probate Judge, upon receipt of a copy of these regulations, shall not thereafter file or record a plat of a subdivision of land located within the City's subdivision jurisdiction, as defined herein, without the approval of such plat in accordance with these regulations. No street or road shall be accepted and maintained by the City, nor shall any services or utilities be extended to the subdivision, unless and until the requirements set forth in these regulations have been complied with and the same has been approved by the Planning Commission. ;b0;4-1-1;en;;hg;Exceptions. No Planning Commission approval is required where property is divided by:

    1.

    Probated family estates.

    2.

    The public acquisition by gift or purchase of strips or parcels of land for the widening or opening of streets or for other public uses.

    3.

    Property that is divided by an individual and given or sold to parents, spouses, sisters or brothers, children or grandchildren, either adopted or natural, where no streets or roadway access to the lots is involved and where lots are not less than the minimum lot size as herein required.
