§ 11-1. Planned unit developments.

  • The intent of this section is to provide an opportunity for the best use of land, protection of valuable natural features in the community, provision of larger areas of recreational open space and more economical public services. The purpose of this provision is to encourage the unified development of tracts of land by permitting, much more creative and flexible concepts in site planning than would otherwise be possible through the strict application of minimum and maximum requirements of the Subdivision Regulations.

    11-1-1  Definition. A Planned Unit Development (PUD) must meet each of the following criteria:

    (1)

    Land under unified control, planned and developed as a whole in a single development operation or approved programmed series of development operations for dwelling units and related uses and facilities;

    (2)

    Includes principal and accessory uses and structures substantially related to the character of the development itself and the surrounding area of which it is a part;

    (3)

    Developed according to comprehensive and detailed plans which include not only streets, utilities, lots, or building sites and the like, but also site plans, and detailed plans for other uses and improvements, facilities, and services as will be for common use by some or all of the occupants of the planned unit development, but will not be provided, operated, or maintained at public expense.

    11-1-2  Ownership. In complying with the foregoing definition, single ownership shall be construed to include the following:

    (1)

    A person, partnership or corporation

    (2)

    An association of property owners, legally bound to one another, to carry out the provisions of this section for development and operation of a Planned Unit Development, likewise legally bound to execute the agreements as provided hereinafter.

    (3)

    The owner's association of a condominium project, established under the provisions of Alabama law, which has the power to execute the agreements as provided for hereinafter.
