  • Administration of the Subdivision Regulations is a joint effort of the Atmore Planning Commission and the City of Atmore. The roles and responsibilities of all involved in the administration of these regulations is described as follows:

    I.

    SUBDIVIDER.

    a)

    Obtains copies of the application forms and subdivision requirements from City Clerk.

    b)

    Coordinates with the Planning Commission prior to development of the plat.

    c)

    Prepares plats in accordance with subdivision regulations.

    d)

    Fifteen days prior to Planning Commission meeting submits application form with names and addresses of adjacent property owners; pays applicable fees; and submits appropriate number of copies of preliminary plat and construction plans to City Clerk.

    e)

    Subdivider or his representative attends Planning Commission meeting and public hearing.

    f)

    When preliminary plat is approved, the subdivider may begin construction of required improvements as approved by the Planning Commission.

    g)

    Subdivider's engineer shall supervise and inspect construction as required to insure compliance with the Subdivision Regulations and City and/or Utility Board specifications.

    h)

    Notifies City Engineer when improvements are ready for inspection.

    i)

    Within one year of preliminary plan approval, submits an application form, pays applicable fees and submits appropriate number of copies of the final plat 15 days prior to Planning Commission meeting.

    j)

    If required improvements are not complete, provides a financial guarantee or surety bond to insure the construction of improvements.

    k)

    Dedicates all improvements to the City and/or the Atmore Utilities Board.

    l)

    Obtains signatures on final plat from the Atmore Utilities Board, Escambia County Engineer and Escambia County Health Department.

    m)

    Submits "Certificate of Construction for Acceptance of Subdivision" and "as-built" engineering plans at completion of improvements.

    n)

    Files maintenance guaranty bond with City of Atmore.

    o)

    Records plat in the Office of the Escambia County Probate Judge.

    II.

    CITY CLERK - SECRETARY OF PLANNING COMMISSION.

    a)

    Distributes copies of the Subdivision Regulations and application forms to applicants.

    b)

    Receives and stamps date on all applications.

    c)

    Collects appropriate fees.

    d)

    At the time each plat is filed, keeps one copy of the plat for the Planning Commission and distributes other copies 15 days prior to the Planning Commission meeting to:

    Building Inspector

    ο

    City Engineer (two copies)

    ο

    Planning Consultant

    ο

    Utility Board

    ο

    County Health Department (if city sewer is unavailable)

    ο

    County Engineer

    e)

    Sets up and notifies applicant and adjacent property owners of public hearing.

    f)

    Prepares agenda.

    g)

    Notifies planning commission members, city engineer and planning consultant of all meetings and sends out minutes of previous meeting.

    h)

    Takes minutes of all meetings.

    i)

    Maintains copies of all applications, maps, plats, notices, resolutions, correspondence and other business of the Planning Commission.

    III.

    CITY ENGINEER.

    a)

    Provides technical expertise to applicant, planning consultant and commission members regarding proposed subdivision developments.

    b)

    Receives two copies of each plat from City Clerk.

    c)

    Reviews design aspects of subdivision plat and makes on-site inspections of property proposed to be subdivided.

    d)

    Attends Planning Commission meetings and presents recommendations and findings for each plat.

    e)

    Coordinates and makes inspections of all required improvements to insure compliance with Subdivision Regulations and determines the acceptability of work.

    f)

    Approves and signs all plats as required by the Subdivision Regulations.

    g)

    Recommends to Planning Commission when streets and other improvements are acceptable for maintenance by the City and/or Utilities Board.

    IV.

    PLANNING CONSULTANT.

    a)

    Consults with applicant and answers questions regarding plat requirements.

    b)

    Receives each plat from City Clerk.

    c)

    Reviews plat and makes on-site inspections of-the property proposed for subdivision development.

    d)

    Attends Planning Commission meetings to present and discuss findings and recommendations relative to each application for subdivision development after consultation with the City Engineer.

    V.

    BUILDING INSPECTOR.

    a)

    Coordinates with applicant prior to development of plat.

    b)

    Receives each plat from City Clerk.

    c)

    Reviews plat and makes a recommendation to the Planning Commission.

    VI.

    UTILITY BOARD.

    a)

    Receives plat from City Clerk.

    b)

    Reviews plat for compliance with applicable Utility Board requirements and submits a recommendation to the Planning Commission.

    c)

    Inspects utility improvements to assure compliance with Utility Board Requirements and Subdivision Regulations.

    d)

    An official representative of the Utility Board signs final plat when in compliance.

    e)

    Accepts utility improvements for maintenance upon recommendation of the City Engineer.

    VII.

    COUNTY ENGINEER AND COUNTY HEALTH DEPARTMENT.

    a)

    Receives each plat from City Clerk.

    b)

    Reviews plat of proposed subdivision development for compliance with applicable requirements.

    c)

    Signs final plat when in compliance.

    VIII.

    PLANNING COMMISSION.

    a)

    Holds a regular monthly meeting.

    b)

    Receives applications for subdivision development within the planning jurisdiction.

    c)

    Conducts public hearing on preliminary plat applications.

    d)

    Reviews input and recommendations from the City Engineer, Planning Consultant, Utilities Board and Building Inspector on proposed subdivision developments.

    e)

    Takes one of the following actions on subdivision applications:

    ο

    Approves plat as requested;

    ο

    Approves with conditions or subject to minor modifications, which shall be stated.

    ο

    Tables the application for 30 days for more information; or

    ο

    Denies the application with reasons for disapproval stated in writing upon the records of the Commission.

    f)

    Chairman of the Planning Commission signs final plat after all other approvals required for recording are obtained.

    g)

    Recommends acceptance of streets for maintenance to the City Council.

    IX.

    CITY COUNCIL.

    a)

    Accepts fees on behalf of the Planning Commission and appropriates funds for the operation of the Planning Commission.

    b)

    Approves surety bonds when submitted by the subdivider.

    c)

    Accepts streets for maintenance upon recommendation of the Planning Commission and City Engineer.

    d)

    Approves maintenance guaranty bonds.

    e)

    Instructs City departments to assist in the enforcement of the Subdivision Regulations.

    f)

    Through its attorney, takes appropriate legal action to enforce the Regulations when necessary.
