§ 2-6. Council to appoint city officers; department heads to hire employees subject to council approval.

  • (a)

    The mayor has the power to appoint all officers, whose appointment is not otherwise provided for by law under state law, and whereas the city council may, by properly drafted ordinance, provide a different appointing power when the Code of Alabama is silent as to the appointing powers and may either exercise this appointing power or delegate it. The city council desiring to exercise all appointing powers in connection with all officers of the city whose appointment is not otherwise provided for by law does hereby expressly vest such power in the members of the city council and remove such power of appointment from the mayor.

    (b)

    The power to appoint the following named officers and all officers whose appointment is not otherwise provided for by law is hereby expressly vested in the city council to include, but not be limited to, the following officers of the city:

    (1)

    Street superintendent.

    (2)

    Housing inspector.

    (3)

    License inspector.

    (4)

    Code enforcement officer.

    (5)

    Sanitation superintendent.

    (6)

    Recreational director.

    (7)

    Any and all other department heads as to all departments now in existence or created in the future.

    (c)

    The city council does hereby delegate expressly to the head of each department of the city the authority to hire the employees in such department, subject to approval by the city council. This meaning the employees of the fire department, police department, street superintendent or sanitation department will be hired by departmental heads and submitted for approval by the city council.
