§ 36-11. Hunting prohibited within city limits.

  • (a)

    It shall be unlawful for any person to hunt game or other wildlife within the city limits of Atmore. Hunting shall include pursuing, shooting, killing, capturing and/or trapping game animals, wild fowl, wild birds, and all lesser acts, such as disturbing, harrying or worrying, or placing, setting, drawing, or using any device used to take game animals, wild fowl, wild birds, whether they result in taking or not, and includes every act of assistance to any person in taking or attempting to take game animals, wild fowl, or wild birds.

    (b)

    This section shall not apply to law enforcement officers and animal control officers in the execution of their duties, to persons acting pursuant to an animal control contract with the city or to persons that the city and/or the appropriate state agency have permitted and/or authorized to engage in such activities in order to abate or eliminate a public nuisance or in the interest of the public, health, safety and welfare.
