§ 4-3. Location of retail businesses.

  • (a)

    Definitions. For the purposes of this section:

    300 feet means the distance measured as follows: from a point at the front door of the business to a point in the center of the street directly in front of said business; thence proceed down the center of the street or streets by the nearest direct route to a point in front of the front door of the church, school, school grounds, or park and park grounds in the street; thence to the front door of the church, school, school grounds, or park and park grounds.

    Church shall be limited to the church building.

    Park and park grounds includes the entire premises of any park and park grounds.

    School includes the entire premises on which the school building and facilities are located, including school athletic fields, playgrounds and recreation areas.

    (b)

    No retail business where whiskey, wine, liquor, malt or brewed beverages or other alcoholic beverages are sold or dispensed shall be located within 300 feet of any church, school grounds or parks and park grounds.

    (c)

    No privilege license to operate a retail business selling or dispensing whiskey, wine, liquor, malt or brewed beverages or other alcoholic beverages shall be issued to any retail business located within the prescribed area defined in this section.
