§ 4-4. Submission of preliminary plat

  • The procedure for obtaining Preliminary Plat approval is as follows:

    4-4-1  Application procedure. Based upon the approval of the Planning Commission of the Sketch Plat if undertaken, the applicant shall file an application for approval of a Preliminary Plat. The application shall:

    (1)

    Be made on forms available at the Office of the City Clerk; and

    (2)

    Be accompanied by a filing fee, payable to the City of Atmore, in the amount of $25.00 plus $5.00 per lot to partially cover the cost of advertising, review and administration; and

    (3)

    Be accompanied by at least eight sets of black or blue line prints of the proposed subdivision prepared in accordance with the requirements of the subdivision regulations. The City Clerk will retain one copy of the plat for the file; sends one copy each to the Building Inspector, Planning Consultant and Utility Board; two copies to the City Engineer; one copy to the County Engineer; one copy to the County Health Department if public sewers are unavailable; and

    (4)

    Be submitted to the City Clerk at least 15 calendar days prior to a regularly scheduled meeting of the Planning Commission.

    4-4-2  Public hearing. The Planning Commission shall hold a public hearing on the Preliminary Plat. Notice of such public hearing shall also be sent by the City Clerk to the applicant and all adjoining land owners by registered or certified mail. Such notices shall be sent at least five days prior to the date of the public hearing. Any Preliminary Plat submitted to the Planning Commission shall contain the names and addresses of all persons to whom notices of a public hearing shall be sent. Any change or modification to a Preliminary Plat shall be subject to a public hearing, if deemed necessary by the Planning Commission.

    4-4-3  Preliminary approval. After a duly held public hearing, the Planning Commission, Planning Consultant and City Engineer will review the preliminary plat and construction plans. The Planning Commission decides approval, disapproval, or approval subject to minor modifications. If the Planning Commission disapproves the preliminary plat, the reasons for such action shall be stated in writing upon the records of the Commission, and reference shall be made to the specific sections of the regulations with which the preliminary plat does not comply. If approved subject to modifications, the nature of the required modifications shall be indicated. The Planning Commission shall approve or disapprove a plat within 30 days after the submission thereof to it, otherwise such plat shall be deemed to have been approved, and a certificate to that effect shall be issued by the Commission on demand; provided, however, that the applicant for the Commission's approval may waive this requirement and consent to an extension of such period.

    4-4-4  Effective period of preliminary approval . The approval of a Preliminary Plat shall be effective for a period of one year at the end of which time final approval of the subdivision must have been obtained from the Planning Commission, although the plat need not yet be signed and filed with the Probate Judge. Any plat not receiving final approval within the period of time set forth herein shall be null and void, and the applicant shall be required to resubmit a new plat for preliminary approval subject to all new subdivision regulations and filing fees.

    4-4-5  Resubmission of preliminary plat. The Planning Commission shall not consider, for a period of 12 months, a Preliminary Plat which has been resubmitted for approval after Planning Commission disapproval, unless the applicant has complied with the Planning Commission's required changes and/or additions. Any resubmission shall be subject to a public hearing.

    4-4-6  Preliminary plat requirements. The Preliminary Plat shall be prepared by a registered land surveyor or registered engineer and shall be clearly and legibly drawn at a convenient scale of not less than one inch equals 100 feet, and the sheets shall be numbered in sequence if more than one sheet is used. The sheet size shall be of such size as is acceptable for filing in the Office of the Probate Judge, but shall not exceed 24 by 36 inches. The Preliminary Plat shall show the following:

    (1)

    Name of owners of record;

    (2)

    Proposed name of subdivision, date, north point, scale, and location;

    (3)

    Name and seal of registered land surveyor or registered engineer;

    (4)

    Vicinity map showing location of the subdivision;

    (5)

    Exact boundaries of the tract of land being subdivided, shown with bearings and distances and bearing the signature of a registered land surveyor;

    (6)

    Names and addresses of the owners of land immediately adjoining the tract of land being subdivided;

    (7)

    Wooded areas, marshes, and any other conditions affecting the site;

    (8)

    The location of existing streets, buildings, water courses, railroads, transmission lines, sewers, water mains, drainage structures, public utilities, jurisdiction lines, and any public utility easements on and adjacent to the tract being subdivided;

    (9)

    Proposed rights-of-way or easements including location, widths, purposes, and street names;

    (10)

    Proposed lot lines with bearings and distances and lot and block numbers;

    (11)

    Proposed minimum building setback lines;

    (12)

    Proposed parks, school sites, or other public open spaces, if any;

    (13)

    Site data:

    a.

    Acreage in total tract;

    b.

    Smallest lot size;

    c.

    Total number of lots;

    d.

    Linear feet in streets.

    (14)

    Any area within or adjacent to the proposed subdivision subject to inundation by the 100-year flood as defined herein, or subject to periodic inundation by storm drainage overflow or ponding shall be clearly shown and identified on the plat;

    (15)

    The existing zoning classification of land to be subdivided and any adjoining lands;

    (16)

    Inscription stating "NOT FOR FINAL RECORDING".

    4-4-7  Construction plans. At the time of submission of the Preliminary Plat, the applicant shall also submit Construction Plans for all required improvements. All plans shall meet the minimum standards of design and general requirements for the construction of public improvements as set forth in these regulations. Construction Plans shall be prepared by a Registered Engineer. The following construction plans shall be included:

    (1)

    Street plans containing the following information:

    a.

    Location of all proposed and existing streets or rights-of-way in or adjacent to the subdivision;

    b.

    Width of existing and proposed rights-of-way, easements and streets;

    c.

    Street names;

    d.

    Topography at five foot contour intervals unless a closer contour interval is required by the City Engineer or Planning Commission.

    e.

    Plan and profile of centerline streets, showing natural and finish grades drawn to a scale of not less than one inch equals 100 feet horizontal and one inch equals ten feet vertical;

    f.

    Cross sections of proposed streets at a minimum of 100 foot stations showing existing and finish grades;

    g.

    Curve data for the centerline of each street: Delta, Tangent, and Radius.

    (2)

    Storm Drainage Plan containing the following information:

    a.

    Location of proposed drainageways, streams, and ponds in the subdivision;

    b.

    Topography at two foot contour intervals;

    c.

    Location, size, and invert elevations of proposed drainage structures including culverts, bridges, pipes, drop inlets, etc., showing details on Drainage Plan, including conduit schedule;

    d.

    Show construction details of typical manholes, connections, and other drainage structures proposed;

    e.

    Drainage map showing area of land contributing run-off to each drainage structure along with run-off calculations of each area and drainage calculations for each drainage structure and drainage ditch;

    f.

    Location of easements and rights-of-way for drainageways and maintenance access thereof;

    g.

    Typical cross sections of each drainageway;

    h.

    Direction of waterflow toward and throughout subdivision and compatibility with existing drainage.

    (3)

    Sanitary Sewer Plan, if applicable, containing the following information:

    a.

    Location and size of all existing and proposed sewers in the subdivision and tie-points of the subdivision. Location of sewer laterals;

    b.

    Direction of flow of each sewer line;

    c.

    Location of each manhole and other sewage system appurtenances including lift stations, oxidation ponds, and treatment plants, if any;

    d.

    Construction details of typical manholes, connections, and other sewage structures proposed;

    e.

    Plan and profile of sewage system.

    (4)

    Water Distribution Plan containing the following information:

    a.

    Location and size of water distribution system including pipes, valves, fittings, hydrants and high pressure pumping equipment, as well as information as appropriate on existing facilities.

    (5)

    Gas Distribution Plan containing the following information:

    a.

    Location and size of gas distribution system including pipes, valves, fittings, etc., as well as information as appropriate on existing facilities.

    (6)

    Construction Cost Estimate

    a.

    Itemized cost breakdown of the various components of construction as listed in section 4-4-7.

    4-4-8  Approvals. No Preliminary Plat shall be approved by the Planning Commission until each utility affected thereby shall have been provided at least ten days to review the proposed plat and submit a recommendation to the Commission as to whether all provisions affecting the service to be provided by such utility are reasonable and adequate.
