§ 4-5. Submission of the final plat.

  • In accordance with policy of the Planning Commission, no lot may be sold, or utilities extended to, or connected with, any subdivision of land, as defined herein until the Final Plat has been approved by the Planning Commission.

    4-5-1  Application procedure and requirements. Following the approval of the Sketch Plat in case of a minor subdivision if undertaken, or of the Preliminary Plat in the case of a major subdivision, the applicant, if he wishes to proceed with the subdivision, shall file with the Planning Commission an application for approval of the Final Plat. The application shall:

    (1)

    Be made on forms available at the Office of the City Clerk; and

    (2)

    Be accompanied by the original tracing, and eight.

    (8)

    Black or blue line prints of the plat; and

    (3)

    For minor subdivisions, be accompanied by a filing fee, payable to the City of Atmore, in the amount of $25.00 plus $5.00 per lot to cover the cost of advertising, review and administration. For major subdivisions, be accompanied by a filing fee of $5.00 per lot; and

    (4)

    In addition to the filing fee, also be accompanied by $25.00 for each street sign required in the subdivision; and

    (5)

    Comply in all respects with the Preliminary Plat, as approved, except for minor modifications not altering the design of the subdivision; and

    (6)

    Be presented to the City Clerk at least 15 calendar days prior to a regularly scheduled meeting of the Planning Commission; and

    (7)

    Be submitted within one year of the date of Preliminary Plat approval; and

    (8)

    Be accompanied by a surety bond, if required, in a form satisfactory to the City Council and in an amount sufficient to guarantee the actual construction and installation of such approved public streets, roads, drainage structures and public utilities; and

    (9)

    Be accompanied by an agreement to hold the City harmless for any damages caused by runoff from the development as required in section 5-8(2) herein.

    4-5-2  Signing and recording of final plat.

    (1)

    When a surety bond is required, the Chairman of the Planning Commission shall endorse approval on the Final Plat after the bond has been approved by the City Council and all the conditions pertaining to the plat have been satisfied.

    (2)

    When installation of improvements is required, the Chairman of the Planning Commission shall endorse approval on the Final Plat after all conditions have been satisfied and all improvements satisfactorily completed and approved by the City Engineer.

    4-5-3  Final plat requirements. The Final Plat shall be prepared by a registered land surveyor or registered engineer and shall be clearly and legibly drawn at a convenient scale of not less than one (1) inch equals 100 feet. The Final Plat, as submitted for approval, shall be prepared in ink on linen or a suitable permanent mylar reproducible. The sheet size shall be of such size as is acceptable for filing in the Office of the Probate Judge, but shall not exceed 24 by 36 inches. The Final Plat shall show the following:

    (1)

    Name and address of owner of record and lienholder, name of subdivision, and name and seal of registered land surveyor and/or registered civil engineer;

    (2)

    Vicinity map, date, north point and scale;

    (3)

    The relation of the land so platted to the Government Survey of Escambia County. The "point of beginning" as referred to in the written description shall be so indicated;

    (4)

    Sufficient data to determine readily and reproduce on the ground the location, bearing, and length of every street line, lot line, boundary line, and block line, whether straight or curved. This shall include the radius, central angle, point of tangency, tangent distance, and arc and chords;

    (5)

    The names of owners of record of adjoining land with appropriate acreage and streets;

    (6)

    The exact position of the permanent monuments shall be indicated on the plat by a small circle "o";

    (7)

    Total acreage of platted area;

    (8)

    Streets and alleys, rights-of-way, and street names;

    (9)

    The location of all easements for such utility and drainage facilities;

    (10)

    Lot lines and lot and block numbers;

    (11)

    Minimum building setback lines;

    (12)

    Parks, school sites, or other public open spaces, if any;

    (13)

    Zoning district boundaries, if such exist. Otherwise, indicate the proposed use of and restrictions on each lot within the subdivision. All restrictions are to be recorded on or with the plat;

    (14)

    All dimensions should be to the nearest one-hundredth of a foot and angles within plus or minus five seconds;

    (15)

    The following endorsements, dedications, and certificates shall be placed on the Final Plat (see Appendix I for sample certificates):

    a.

    Registered Surveyor's Certificate and Description of Land Platted;

    b.

    Dedication;

    c.

    A Notary's Acknowledgement of the Dedication Certificate;

    d.

    A Certificate of Approval by the Atmore Utilities Board;

    e.

    A Certificate of Approval by the City Engineer;

    f.

    A Certificate of Approval by the County Engineer of Escambia County;

    g.

    A Certificate of Approval by the Escambia County Health Department (if septic tanks and/or wells are necessary);

    h.

    A Certificate of Approval by the Atmore Planning Commission;

    i.

    A Certificate of Recording by the Probate Judge;

    (16)

    The above certificates shall be lettered or typed on the Final Plat in such a manner as to insure that said certificates will be legible on any prints made therefrom;

    (17)

    In addition to all of the above, the subdivider shall also submit to the Planning Commission copies of all Federal and State permits required for construction of the development shown on the plat.

    4-5-4  Engineering plan. At the time of Final Plat approval, the applicant shall also submit an engineering plan, or "as built" plan, giving details of construction and locations of the improvements which have been installed. The primary purpose of the engineering plan is to provide the City with a record of the location, size, and design of underground utilities for the City's use in the course of maintaining such improvements. If the installation of improvements is completed under a bond, the engineering plan shall be submitted to the City upon request of release of the bond by the applicant.
